The State Of Facebook Advertising
As most of you all have seen in the news there has been a lot of changes around Facebook advertising in the last 12 months and we are now ready to fully explain the changes and what it means to campaigns that you guys might want to run in the future.
Facebook Then and Now
Whereas in the past we could leverage targeting very deep on Facebook down to an interest group (Example; people that used a CPAP device or were interested in Hernia Mesh), now all these health care buckets are gone and we cannot target this way anymore.
The new way of running Facebook advertising is all algorithm based. Think about it like this; I show 1,000 people an ad and I see their reaction to it.The more people I show the ad to the better the algorithm will understand what audience I am looking for. The better it understands my audience the better results will be.
So what that means in dollars is the bigger your budget is on a campaign the more time we have to teach the algorithm what you are looking for.
If you were to take a timeline for campaign performance, the worst results would come in the start of the campaign and as the algorithm learns results get better day after day.
As we get leads in via your landing page, the Pixel starts learning and telling FB what we will accept and what we will decline, and the stronger the campaign gets. This results in cheaper leads over time as the pixel and the campaign “learn” in real-time.
The lead quality and cost are even cheaper than we could get before when we went after the limited audiences that was in the interest buckets. The reason the leads are cheaper now vs before is because of the larger audience size we can now reach.
Before we where limited to an interest audience of maybe 2million people per interest. Now, we go after all 280 million Facebook users and the FB algorithm will know in real-time what they are interested in and who should see what ad.

Where does the New Facebook Algorithm approach work the best?
The more potential new clients that have the same problem, think CPAP, Roundup, Zantac, 3M, Talc, the better this approach will work.
Areas we have seen less strong results with the changes to Facebook would be Church abuse where there is very very few clients. Sometimes however you can overcome the fewer potential client numbers by deploying other tactics like geo-targeting or lookalike audiences.
An example would be Fire Foam or PFOS/PFAS where you know where the military bases are located which is then where water contamination is most likely to be occurring. Another example would be Paraquat where we know where paraquat was sprayed and where the largest quantities where sprayed.
So in some cases you can find a way around the problem but in general Facebook advertising has become similar to TV advertising with a Digital overlay.
Facebook Advertising vs TV Advertising
TV is always just a numbers game it does not get smarter with every dollar you spend. You could argue that the TV buyer optimized his buy based on what stations perform the best by using different numbers for each channel but again that Channel does not become smart over time by the dollars you invest.
On the other hand, for every dollar you invest in Facebook adverting the algorithm learns more and more about your perfect clients as it receives feedback from people seeing and reacting to the ads, and it gets feedback on the landing page level from what an attorney will except as a client and what they will disqualify.
We feed back to Facebook all that information as leads start coming in and the intake talks to them and qualifies them or disqualifies them. So the bigger your investment, the better your results over time, as you teach Facebook about your business and ideal new client.
When we do run into problems on Facebook with spending money fast enough, for scale we do move some budgets to TV for adverting on those channels but when we do it comes with what we call a digital overlay on what we have already learned about the perfect client from Facebook advertising.
We can still see on Facebook what TV channels our perfect audience prefers to watch. So even though our TV advertising is similar to others, it does come with more targeting options than traditional TV buys are offering us today.

Introducing X Social Capital. A New Way To Get Funding

The Problem Explained:
Today in our industry many law firms rely on capital funding via what is normally known as a Hedge Fund loans. The law firm pledges attorney’s fees coming on their Docket in exchange for financing that traditional banks do not offer.
The hedge fund loans are consistently over three times current bank rates and usually over 20% per year. The rates go from about 17% to 24% depending on how good the lawyers docket is. If a law firm loaned 10 million today in 3.6 years, he will owe more than 20 million.
It takes time before the lawyers gets paid and as an example a tort like Roundup has now run for 7 years. While the lawyers get paid well a lot of that profit end up with the hedge funds because of the 17%-24% interest rate.
Probably 50% or more of the law firms we deal with are getting loans like this.
The Solution
We set out to come up with a solution to fix this industry wide problem. We offer a unique product, the first of its kind to be offered commercially, that will insure a Mass Tort docket. The insurance premium to insure a minimum value of a mass tort docket is between 6-12%, depending on collateral, loan amount, etc.  Final premium amount is determined by the insurance carrier.
Our process provides our loan applicant to be matched with the right lender coupled with an A Rated insurance company. The Insurance will guarantee the principal loan amount. A commercial lender that is interested in an insurance company which is A Rated backing these loans will be able to offer a rate that is below current market rates because of the insurance wrapper.
The time it takes for the insurance to rap the mass tort docket is between 45-60 days from start to finish. This allows the insurance company time to do their due diligence on the docket they are insuring. Today we have 5-7 lenders that are willing to engage with us on this product at a very competitive rate.
We see the market in its infancy right now but as more and more people take advantage of A Rated insurance on their Mass Tort Docket we believe we can drive the lending rates down to a healthy level for our industry.

MTMP Preview April 2022

As we are counting down to MTMP April 2022 here are a few things to get ready for if you are going to Las Vegas as a new attendee or as a veteran in the industry.
Here are the Top 3 Things to Focus on at MTMP.
MTMP is for networking. Meet as many people as you can. Don’t forget Business Cards.
There will be parties at the pool, in the Wynn Meeting Room and in the Exhibit Hall. Go meet new Lawyers and Vendors. It only takes one conversation to learn something new and make a new partner for life.
MTMP is for learning about new torts and to understand how current torts are going. Lots of under the radar mass torts will be discussed in the hallways, bars, pool side and you want to get in on one of those that sounds promising. Find good friends that will be your co-counsel on your next project. Our business is all about networking and working towards a common goal- to help the victims. Be approachable and interact with both the lawyers and vendors to get the most out of it.
MTMP is for finding new vendors. You might be a smart lawyer but vendors can help you. Vendors are the lifeblood of your case acquisition, your case workup and your case financing. Find out what is new, who came with the new best thing, who has an inside track on a new case, and what can I use from the different vendors in the Exhibit hall. Don’t miss the exhibit hall or you will be the guy that still thinks the Yellow pages will bring you all the business that you need. Don’t be that guy.

Cracking The Code For PI Advertising On Facebook
For some time, it seemed like no one had “cracked the code” on PI Facebook advertising. This past December, we revealed that one of our friends and close partners, Luke W Russell, the founder of Russell Media, has demonstrated exceptional results in an array of PI campaigns.

For example, one attorney spent $132,000 between Facebook and Russell Media management fees and generated $4,224,783.58 in case results with $1,408,261.19 of that being attorney fees. That’s a 10.7 times return on investment!
The folks at Russell Media have also been running a range of nursing home / elder abuse campaigns, generated substantial six-figure-fee cases there, too, across various markets.
Next thing I know, I get an email from Luke saying that there’s yet another campaign they’ve been rocking and it’s a dog bite campaign. Luke’s case study shows how the law firm went from signing 1-2 cases per month to 4-7 cases per month. Wow!
All of these PI campaigns, Russell Media charges $2,000 per month with most lawyers spending an additional $2,000 to $3,000 per month on ads. So, for five grand a month, you can have Russell Media tapping the power of social in a way that drives real cases to your firm.

Trends in Mass Tort Marketing

So here we are already in March 2022. Where did the time go? Did you get what you wanted done in January and February? We know we have been busy!

For us, 2022 started kinda slow for mass tort marketing spend overall, yet it was really similar to most years prior, and as usual, has picked right back up again and new orders are coming in daily for some of the most popular torts like NEC, Baby Formula contamination, Roundup, Paraquat, CPAP, and a few less known secret ones we can’t tell you all via an email but are happy to discuss with you over a phone call.

Trends we are seeing show that Facebook/Instagram campaigns are back to performing best over time in most cases. We do deploy budgets on radio, TV, digital TV, OTT, and through partners like Google and display networks, but consistently have found through the last couple months, strong trends suggesting that the majority of the eyeballs are still on Facebook. It is where people now go to get their news, not to the news channels.
A NOTE ON TEST BUDGETS
We are also finding that test Budgets just don’t cut it anymore. Clients who are trying to gauge marketing success with budgets only 2-5x what the average cost of a case is will find that they are shooting themselves in the foot by not giving the appropriate time for the test to deploy and optimize. Let our past history on the same projects for other clients be your test.
With Facebook as an example, the algorithm wants 50 pixel fires a week per ad set to optimize your delivery, and anything less is asking Facebook to do more, with less data. So the formula for finding out your starting budget really needs to be = 4 x (Your average CPL x 50) which will give you a monthly budget that is more reasonable to start. As we scale, we can replace CPL with Cost Per Signed case, and the same formula applies.
Moving forward, X Social will be offering 2 ways to get started:
  1. Standard business as usual way we have done business for years, where we setup everything from scratch for your business. Including a dedicated landing page built to your criteria, a dedicated url, tracking phone numbers, etc, and you set a total budget overall for the campaign and we deploy it on your behalf. This is how we already do things today.
  2. A new approach for XSM but more standard in the lead generation space (albeit we don’t believe others have the same level of dedication to ethics “down the lead chain”) where we setup generic campaigns using XSM owned brands, and then control all of the traffic going to the page for lead gen and then sell* on a cost per lead basis per day into our X Portal Marketplace the leads to our clients running those campaigns. Here, we still need a budget, but your budget will earn you a right to the auction each day for leads. Budgets under 50k for the most part, will be option 2 moving forward. Once successful, we can go move to option 1 with larger budgets.
By doing things in these two different ways, it allows us the benefit of the history of success on each campaign instead of launching brand new campaigns for each client each and every time a new project is started. The caveat is then the criteria becomes the same for each campaign, so if you have criteria that doesn’t match what is standard, then you will need to go with option 1. Option 2 can also be used to supplement leads generated from Option 1 for clients who want to scale faster.
