LEGAL SUMMARY ON THE 2021 ENERGY FAILURES IN TEXAS DURING THE ARTIC FREEZE FROM BRENT COON & ASSOCIATES
OK folks.  Today is UTILITY LAW 101.  Back when I was in law school I had actually been hired prematurely to go to work for the regional energy company, ENTERGY, when I graduated.  Accordingly I took some courses suited for that arena, including regulatory law and utility law.  Fortunately (I guess anyway), I was hired away to go work for the good guys with the Plaintiff bar and rest is history…lol.

Anyway, much has passed since then with respect to how utilities work in Texas, and a number of other laws have passed in the interim, so I have had to go back to the books and see what the lay of the land is with respect to litigation associated to this major disaster.

The first question we always ask, is who can be sued and what types of cases are viable.

Unfortunately, right now it is a very fluid situation and there are very few definitive answers.  Already some lawyers have filed cases of one sort or the other, and in my opinion somewhat hoping for the best.

Here are the two basic types of cases to look at and I will provide some more insight into both.

First, we have a ton of businesses and residences shut down for a week or longer with freezing and subfreezing weather, many with no heat source due to loss of power.  As a result, pipes froze and water poured out everywhere when power was restored and/or the lines thawed out.    Do we have viable cases there.   YES.

1. We have direct action or first party cases for property damage.  Most policies have some deductible but otherwise are good cases to have with a Public Adjuster and/or contractor who can do a workup on the case and maximize the value. Granted some can get amicably resolved with a carrier without a lawyer, but many times lawyers need to step in.   Likewise, businesses not only have those types of damages, but also business interruption.  Many of these policies have a certain period of time before they kick in but worth looking at due to the extended nature of the shutdown.  We have a team of forensic analysists who work up these numbers.  Surprisingly many business owners don’t even think to look for interruption coverage on their polices, they just want to get opened back up and make up for lost time.

2. The energy sector may or may not be viable here as third party defendants.  Not only for the physical damages but consequential damages as well. All of this will be discussed further in more detail.   ERCOT is the statewide (for the most part) energy provider in charge of operating the power grid under the auspices of the Texas Public Utility Commission (PUC)  but is also  a 501.C.4 non-profit.   Texas has provided significant sovereign immunity to agencies and a restrictive tort claims cap on just about everything else.  In addition, there is a Texas Charitable Immunity and Liability Act which may well provide another layer of protection to ERCOT.  Adding yet another layer of problems is the fact that ERCOT only oversees the grid, not the process itself and cannot force providers to properly winterize their equipment.

Second, we have tragic loss of life.   Those cases are going to face some difficulty under the present law, but there is certainly hope.  Some of the issues involving immunity of ERCOT and the utility system is in front of the Texas Supreme Court at this very minute.  See Electric Reliability Council of Texas, Inc. v. Panda Power Generation Infrastructure Fund, LLC D/B/A Panda Power Funds, et al.  Essentially, the case stems from ERCOT’s urging Panda Power to build three power plants after the 2011 ice storm in Texas strained Texas electricity-generating capacity.  Panda Power spent more than 2 billion dollars to build the power plants, however, the demand for increased electricity generation did not materialize. Panda sued ERCOT for $2.7 billion alleging fraud and breach of fiduciary duty. ERCOT claims that it has sovereign immunity. As such, the question before the Supreme Court is whether ERCOT, as a private nonprofit, is protected by sovereign immunity, which has yet to be determined.

Third, we have a myriad of other losses of all sorts directly or indirectly attributable to the widespread power outages.  Each has to be looked at individually with the issues pointed out above and below to take into consideration.

UTILITY COMPANY “PROVIDER” LIABILITY

Assuming that ERCOT has immunity as a sovereign governmental agency, lack of liablity, Tort Claims damage cap or even charitable immunity 501c4 nonprofit status, that leaves us primarily with the energy providers to the grid.

There are a number of tricky issues here.

1.  There  are 600 energy providers in the grid. Which ones performed and which ones didn’t have to be segregated out.
2. There is no REQUIREMENT in the ERCOT grid for any particular energy provider to perform at any particular level, so there is an argument right off the bat that since they had no duty to perform at a specific level, they had no duty to perform at ANY level.
3. A major portion of the consumers out there have “choice” electric provider agreements.  Those agreements usually have a standard provider contract with the customer with significant legal problems to address.  One, they have arbitration clauses, which are generally enforced in Texas. Two, they almost all have a “force majeure” clause, which basically states the utility is NOT liable for damages associated to a wide variety of weather conditions or other “acts of God” (or Budha, Allah or any other omnipotent being).
4. There are rumblings that some providers couldn’t get fuel (usually natural gas) to operate their plants because:
a.  The pressure in the lines allegedly fell below production limitations due problems in the distribution system (frozen lines, etc).
b.  The price point SPIKED to hundreds of times higher rates than normal, likely causing some buyers to hold off.  (not proven yet but likely).
c.  The pressure in the lines may well have fell also from direct consumer demand for natural gas for direct heating of HVAC systems, fireplaces, etc

PRICE GOUGING ALLEGATIONS

Many consumers have already been tagged for huge gas bills they ran up heating their homes through natural gas heaters/fireplaces, etc.   This seems like it has the makings of some sort of consumer fraud and unfair price gouging claims attached to it.  Arguably this falls under the Texas Deceptive Trade Practices Act but the State has prosecuted wholesale price gouging issues in the past, typically associated to inflated prices for gas in shortages, water in emergencies, etc.

The problem here is that most consumers entered into FLOATING contracts, in which there is no set price for the energy.  The PUC used to strictly regulate prices and the energy providers had to petition for increases every year and it was reviewed on a performance basis.  Some number of years ago, the State decided to “open up” the energy sector to free enterprise capitalism.  This invited in our very own GRID system, ERCOT, rather than attaching to a more predictable and stable national grid with the Feds that every other state pretty much adheres to.   As a consequence, most contracts with providers acknowledge that the price is whatever it is, and is passed on directly to the retail consumer. So when fuel got scarce, demand hit the roof, the price then went THROUGH the roof.  Hundreds of times OVER the typical prices seen in a monthly cycle.  Residents used to seeing a $100 monthly bill are getting $10,000 dollar bills, and that is just for the one week.  Right now the Governor has egg on his face, as do most other state officials, so they are all saying that the providers cant force those payments right now, can’t disconnect, and can’t charge interest.  How that all shakes out is anyone’s business.

In the meantime, while there are legal hurdles to those claims, there may be a solution at the end of the day that includes some benefits to those who litigate.  It may be that the State steps in and makes some decision that impacts all that group and circumvents their ability to litigate. Again, a lot of political maneuvering will take place with this one.

Until we hear from the Supreme Court later in the year on the blanket immunity issues, our present plan is to help put together an MDL that addresses all these issues in an organized format.  Our firm is working with several other leading firms in this arena to file pleadings that follow the legal analysis mentioned above and try to steer clear of the rocks.

Due to the massive nature of these proceedings and the number of involved parties plaintiff and defendant, we see this one somewhat like the BP Oil Spill.  We were able to predict and maneuver over 99% of our 10,000 plus cases into a settlement on that one, probably much better than any other firm, by selectively analyzing with path was best for each type of case.  There should not be a cookie cutter analysis to cases with this much complexity. There will be a large number of cases from the private sector, consumers, businesses, and even other governmental units.  It is going to take some time to sort out, and a great deal of legal elbow grease.

VENUE ISSUES
As many of the providers are state of Texas entities, we are going to initially and primarily proceed on that format.  We have a class actions department, and will likely file one or more class actions in the near future. Note that the Federal Class Action Fairness Act may apply, and if it does, those will all likely either be filed in Federal Court or see them removed to Federal Court.   There are some arguments around it but again, time will tell.

Texas Power Grid Claims Update

As the Texas Power Grid Failure Claims have now launched, we now have the data to tell everybody a bit more on what we are seeing.
At this moment we have seen 689 leads at a price of $12.88 (incl. Management fees), we are seeing personal injury, Business Claims and Private Claims. We are seeing a lot of water damage to properties in Texas. As the funnel gets optimized we are seeing a 15% sign up rate right now on the leads. We should have this number above 20% as the funnel gets optimized and the leads mature in time to contact.

A Quick Update to the Strategy on the Claims

Is the Texas Power Grid Failure Shaping Up to Be the Next BP Oil Spill?

As most of you know that read my newsletter, I got my start in this business 10 years ago during the BP Oil Spill and I now see something similar happening in Texas. However, the more I look into it I would consider this a “California Wildfire Case” more-so than a “BP Oil Spill Case.” Let me explain..
In this situation you have a 100 year winter storm that hits Texas and you have local power companies not able to deal with the demand and supply needs during this period resulting in 3-5 million people without power for 48 hours or longer in 15 degree weather. This will create a lot of commercial claims, property claims and personal injury claims.
I think the local power companies are on the hook, I think Insurance companies not covering damages fully and denying initial claims are on the hook for this power failure.
As Texas is still in a deep freeze the story has not been fully written yet on what happens next but this coming weekend is when temperatures start warming up again and the busted pipes will start flooding homes from Dallas to Saint Antonio.  The property damages will become really bad on both Private properties and Commercial Installations.
Now in the BP Oil Spill and California wildfires the biggest claims where the commercial losses from the event. Similar here Commercial operations with things that need power to not go to waste or to grow will have the largest damages. Think about the chicken farmer who’s new chicks die because the heat that should have kept them alive fails or the grocery store where all the goods freeze because there is no heat. The damages here are substantial when you start thinking about what power/heat loss can do to businesses and private homes.
The second part would be injury and death from the cold hitting elderly people that get hypothermia or worse. Think about the medical devices people use that need power like CPAP Machines, Breathing machines, home dialysis equipment and Oxygen equipment. Again no end to the problems and injuries that could arise from a situation like this.
So here is the plan on what we are going to do to help as many people in Texas as possible with their economical damages or personal injury cases and it will be a lot of people.

Digital TV & The Effect On Personal Injury Advertising

I hear it a lot when I talk to Personal Injury Lawyers, ” I can’t compete with “Insert Name” in my local market as he spends Millions on advertising and I just can’t compete with that.
Well just like we changed the game for the mass tort lawyers by allowing the guy that wanted to spend $10,000 or $20,000 a month on Mass Tort compete “with the big guys” by using the Facebook platform, we are now doing the same for Personal Injury through Digital TV.
The changes we are proposing below for a new form of Digital TV Advertising will do the same in the local marketplace for Personal Injury Advertising. The reason being you will know your cost before you even enter the market place for Personal Injury. You will know what a call costs you and if you want to spend $10,000 a month in your local market on Personal Injury then you will know that as an example 50-75 calls will come in (dependent on local market and budget). Once you have established your conversion rate in your local market on the calls you will get to your cost per signed case.
So a small office could say, ‘”We just need 5-10 signed cases a month and we are golden.”
To do so, first we figure out what your conversion rate is on the calls and then we give the local TV stations a “Cost Per Action” number for your local market that will get you to those 5-10 cases a month with an ROI you can live with. If we assume the conversation rate on the calls are 10% and you are ok with a $2,000 cost per case in your local market we can offer the TV stations $200 per Action (Call).
Again we can put advertising in your local market for Personal Injury Cases knowing our Key Performance Indicators (KPIs) are as much in our favor as we can get it before we start advertising or taking risks.
  • Stability – You can get as much advertising as you want giving you a stable source of “Cost Per Action”
  • Predictability – After your first run you will know Conversion Rates and Cost per Case as “Cost Per Action” is stable, and even tends to go down as we dial things in.
  • Scalability – If you need more we can scale it faster by putting your offer out to more Local Stations.
  • Advertising risk – We let the media (TV Stations) take the risk, because that is how we roll!
Now the next question I always get from personal Injury Lawyers is this one, you may be guilty of asking this; “Well I really only want “18 Wheeler Cases that involve a motorcycle and a commercial van, can you target just for those?” So with Digital TV we now can do that as well. The spot we give the local TV Stations could be a spot with a singular focus on Trucking Cases, Motorcycle Case or Wrongful Death Cases. Because we only pay when somebody takes Action. Of course they are harder to find then regular MVA cases so our dollars we offer for an action has to be higher for the TV stations to run it; but our targeting coming from our Facebook data helps us in narrowing down what TV stations we should send the offer to and should help us and the TV stations produce a good ROI from the Cost Per Action model.
January will be filled with more Personal Injury Digital TV tests in different markets and as soon as we have numbers from different local markets we will post our findings on our website so the opportunity becomes transparent for all of our clients.
That isn’t saying you need to wait to get started, but if you are more risk adverse and need more data before you make your decisions, we will have that for you shortly.

Digital TV: Stability and Scalability

Digital TV starts with a Look-A-Like Audience that we get from Facebook to find out what demographics, interests and behaviors our perfect clients have. With that in hand we can now pair that with their TV watching habits. While we all know that TV is typically a shotgun approach to advertising, by making a look-a-like audience for our TV buy it will narrow the audience down from being very large to being a little more targeted. It’s nothing like Facebook that looks at tens of thousands of data points, on Digital TV we look at maybe a thousand data points to narrow down our audience. While this is an improvement over traditional TV buys and offers the scalability of regular TV, it still is missing the predictability of Facebook and we also have not mitigated the risk of advertising where a spot can bomb and you’ve spent $25,000+ and get no sign-ups.
So we knew we had more work to do. We needed to find a way to mitigate some of the risks.
Digital TV: Mitigating The RISK
The next step was to try and mitigate the risk of traditional TV buys and create some predictability in the results like what we are seeing from Social Media advertising. The results ended up coming from a digital KPI metric we know as “Cost Per Action”. What if we could tell the Local and National TV stations that we would pay them on “Cost Per Action” thereby mitigating our risk where if we got no actions from the spot, it would not cost us anything? Almost sounds to go to be true right ?

Think about it in another way, what if we told the TV stations that by using our “Cost Per Action” model, we would actually be able to pay them more then they got from regular CPM or Spot advertising if the TV Spot ran to the Correct audience? So you show the TV Stations the upside and then of course you test and you test and then you test some more to get a WIN-WIN between our clients, the TV stations and the victims getting help. So now we have mitigated the risk by off-loading the risk onto the Media or the TV stations to make it work within our preset economics or they don’t get paid.

You can imagine the TV stations selling a spot on a “Cost Per Action’ getting no actions on the offer. Well I am sure in most cases it will only run one time as they did not make their money on it. What about the Law Firms when they run TV Advertising? Do you honestly think they understand their attribution metrics so well where they can stop a spot after one insertion because they did not see any actions on the offer? I think the law firm becomes the sucker, and will just keep paying the TV advertising without any RISK mitigation and after the campaign is done say “Well you can’t win every time” and chock it up to (name your own excuse here)…In my book and in a digital world these risks are called inefficiencies that do not help the Law Firm, or the victims, so they have to be eliminated.

Digital TV: Predictability

So we are down to one metric we need to square away and that is predictability. If you ask 100 X Social Media Clients what they will say they like the best about advertising on Social Media platforms with digital advertising is it’s the predictability of the results coming out the other end. For long term success in any business you have to have predictability to succeed. You get predictability from knowing your metrics and having enough data so the AI algorithm and Machine Learning on top can do its job on the advertising platform. Now unfortunately we have none of that on TV that we can work with, but we do have metrics we control. Let me explain.

We have two metrics we can control. One being the “Cost Per Action”. To understand Cost per action it goes something like this. We will report back to the TV stations the number of people taking action on our offer, taking action means they call the 800 number and they talk to our intake for 30sec maybe 1 min depending on what deal we can make with the stations. So we now take no risk when we advertise on Digital TV as we only pay when people call our intake and stay on the phone for a minimum of 30seconds. That of course leads to optimization on the intake side of things where you can ask 1-3 questions right up front to increase the probability of the caller qualifying.

SO the Intake script all of a sudden becomes really important because we want to accomplish 2 things; First, we want to make sure that people are qualified and we want to be honest with the TV station on what we are seeing as the more money the traffic from the TV station makes the TV Station the more inclined they will be to run our offer. So we move our intake questions around a little bit so that the main qualifying questions are up front and within the first 30 seconds.

Example Zantac Intake Script for Digital TV

  1. Did you take Zantac Over The Counter or via a prescription ? Yes/NO
  2. Have you been diagnosed with a Cancer ? What Cancer ?

Getting this out of the way early you have put up the main qualifying criteria and you are now ready to pay the TV station for an “Action.” Lets say we pay $100 per Action.

The second metric we can control is Conversion Rate. With big data we know that once you run a ton of traffic the conversion rate on that traffic stays pretty predictable over time. True you don’t know the conversion rate up front but after a couple $100,000 on each Mass Tort X Social Media will know it and share it on our website with our clients. So lets say that on our example above our conversion rate in 15%. That means for every 6.4 people I talk to I get one conversion (Signed Case). So our Cost Per Action offer for Zantac of $100 and with a conversion rate of 15%, gives us a final case cost for the advertising of $640.
Mass Torts & Personal Injury On Digital TV

Once we have defined the new metrics with the TV Stations – there are over 10,000 between Local and National and Cable, Direct TV and All the Cord Cutting Apps – we are now getting somewhere. And Now we start testing.

The first project we used this on at scale was towards the end of the Boy Scouts of America campaign. We clearly defined the Digital TV audience from a Facebook Look-A-Like Audience we had created through our previous $15M Facebook advertising spend to date. We ended up being able to pushing $2M in additional ad spend through Digital TV in the last few weeks of the BSA campaigns, generating cases for us between $1,000-1400 on average.

This “Cost Per Action” offer came in where our BSA started out on Facebook and after more then 10 million spend on Facebook, prices on FB started to go up where Digital TV started to go down. This amongst other reasons was because of the TV Bandwidth compared to the Facebook/Instagram bandwidth and saturation at the time. In our Digital TV offer we did go after the Open States as well so we segmented the campaigns to spend more in open states. (Open States are states that have legislation for a look back to when people were minors for any sexual abuse)

Zantac, Talcum powder, and Roundup are other campaigns we have run based on Look-A-like audiences from Facebook based on Qualifying Cancers. These campaigns all worked well as digital TV Campaigns + Facebook.

Now that we have laidout our Digital TV strategy we are ready to deploy it with our clients. In the new year we will start publishing Digital TV cost per Case and Facebook Cost per case on all torts we run. We hope our clients and new clients will try out our Digital TV strategy and enjoy the stability, predictability, scalability and most of all mitigating the risk of advertising on TV.

First, I want to wish everybody a Merry Christmas and a Happy New Year. I also want to offer my condolences to anybody that has gone though hardship in 2020 with family, friends or relatives being victims of the Covid Pandemic. I wish you all the best as we look forward to a better year in 2021.

My wife and I started X Social Media 5 years ago and we have had a wonderful time establishing long-term friendships in the Mass Tort industry as we have worked tirelessly in perfecting Social Media advertising to help as many victims as possible of corporate neglect, sexual abuse and environmental disasters. We have found our calling in helping others for the greater good. We slowly became a leader in the Social Media advertising space for Mass Torts, by being transparent with our clients and offering up all our know-how to anybody that would come and ask for help or wanted to do what we do in helping victims. The 2018 book that we published “The Facebook Effect For Lawyers” was a blueprint to our way of advertising and was done so other law firms themselves would start their own Facebook advertising to again help as many victims as possible get resolution.

Now the time has come for a few changes that I will briefly describe below;
Digital TV By X Social Media

As the pandemic raged on in 2020 we decided to go into Sandbox testing mode to find and test new ways to help victims. This took us across many different media channels that we tested for four mainstays; stability, predictability, scalability and advertising risk. What came out on top as the clear winner from over $3 Million dollars worth of testing is a new product that we will be able to offer in 2021 to all our current clients. This new product we call Digital TV.

Digital TV: Stability and Scalability

Digital TV starts with a Look-A-Like Audience that we get from Facebook to find out what demographics, interests and behaviors our perfect clients have. With that in hand we can now pair that with their TV watching habits. While we all know that TV is typically a shotgun approach to advertising, by making a look-a-like audience for our TV buy it will narrow the audience down from being very large to being a little more targeted. It’s nothing like Facebook that looks at tens of thousands of data points, on Digital TV we look at maybe a thousand data points to narrow down our audience. While this is an improvement over traditional TV buys and offers the scalability of regular TV, it still is missing the predictability of Facebook and we also have not mitigated the risk of advertising where a spot can bomb and you’ve spent $25,000+ and get no sign-ups.
So we knew we had more work to do. We needed to find a way to mitigate some of the risks.
Digital TV: Mitigating The RISK
The next step was to try and mitigate the risk of traditional TV buys and create some predictability in the results like what we are seeing from Social Media advertising. The results ended up coming from a digital KPI metric we know as “Cost Per Action”. What if we could tell the Local and National TV stations that we would pay them on “Cost Per Action” thereby mitigating our risk where if we got no actions from the spot, it would not cost us anything? Almost sounds to go to be true right ?

Think about it in another way, what if we told the TV stations that by using our “Cost Per Action” model, we would actually be able to pay them more then they got from regular CPM or Spot advertising if the TV Spot ran to the Correct audience? So you show the TV Stations the upside and then of course you test and you test and then you test some more to get a WIN-WIN between our clients, the TV stations and the victims getting help. So now we have mitigated the risk by off-loading the risk onto the Media or the TV stations to make it work within our preset economics or they don’t get paid.

You can imagine the TV stations selling a spot on a “Cost Per Action’ getting no actions on the offer. Well I am sure in most cases it will only run one time as they did not make their money on it. What about the Law Firms when they run TV Advertising? Do you honestly think they understand their attribution metrics so well where they can stop a spot after one insertion because they did not see any actions on the offer? I think the law firm becomes the sucker, and will just keep paying the TV advertising without any RISK mitigation and after the campaign is done say “Well you can’t win every time” and chock it up to (name your own excuse here)…In my book and in a digital world these risks are called inefficiencies that do not help the Law Firm, or the victims, so they have to be eliminated.

Digital TV: Predictability

So we are down to one metric we need to square away and that is predictability. If you ask 100 X Social Media Clients what they will say they like the best about advertising on Social Media platforms with digital advertising is it’s the predictability of the results coming out the other end. For long term success in any business you have to have predictability to succeed. You get predictability from knowing your metrics and having enough data so the AI algorithm and Machine Learning on top can do its job on the advertising platform. Now unfortunately we have none of that on TV that we can work with, but we do have metrics we control. Let me explain.

We have two metrics we can control. One being the “Cost Per Action”. To understand Cost per action it goes something like this. We will report back to the TV stations the number of people taking action on our offer, taking action means they call the 800 number and they talk to our intake for 30sec maybe 1 min depending on what deal we can make with the stations. So we now take no risk when we advertise on Digital TV as we only pay when people call our intake and stay on the phone for a minimum of 30seconds. That of course leads to optimization on the intake side of things where you can ask 1-3 questions right up front to increase the probability of the caller qualifying.

SO the Intake script all of a sudden becomes really important because we want to accomplish 2 things; First, we want to make sure that people are qualified and we want to be honest with the TV station on what we are seeing as the more money the traffic from the TV station makes the TV Station the more inclined they will be to run our offer. So we move our intake questions around a little bit so that the main qualifying questions are up front and within the first 30 seconds.

  1. Did you take Zantac Over The Counter or via a prescription ? Yes/NO
  2. Have you been diagnosed with a Cancer ? What Cancer ?

Getting this out of the way early you have put up the main qualifying criteria and you are now ready to pay the TV station for an “Action.” Lets say we pay $100 per Action.

The second metric we can control is Conversion Rate. With big data we know that once you run a ton of traffic the conversion rate on that traffic stays pretty predictable over time. True you don’t know the conversion rate up front but after a couple $100,000 on each Mass Tort X Social Media will know it and share it on our website with our clients. So lets say that on our example above our conversion rate in 15%. That means for every 6.4 people I talk to I get one conversion (Signed Case). So our Cost Per Action offer for Zantac of $100 and with a conversion rate of 15%, gives us a final case cost for the advertising of $640.
Mass Torts & Personal Injury On Digital TV

Once we have defined the new metrics with the TV Stations – there are over 10,000 between Local and National and Cable, Direct TV and All the Cord Cutting Apps – we are now getting somewhere. And Now we start testing.

The first project we used this on at scale was towards the end of the Boy Scouts of America campaign. We clearly defined the Digital TV audience from a Facebook Look-A-Like Audience we had created through our previous $15M Facebook advertising spend to date. We ended up being able to pushing $2M in additional ad spend through Digital TV in the last few weeks of the BSA campaigns, generating cases for us between $1,000-1400 on average.

This “Cost Per Action” offer came in where our BSA started out on Facebook and after more then 10 million spend on Facebook, prices on FB started to go up where Digital TV started to go down. This amongst other reasons was because of the TV Bandwidth compared to the Facebook/Instagram bandwidth and saturation at the time. In our Digital TV offer we did go after the Open States as well so we segmented the campaigns to spend more in open states. (Open States are states that have legislation for a look back to when people were minors for any sexual abuse)

Zantac, Talcum powder, and Roundup are other campaigns we have run based on Look-A-like audiences from Facebook based on Qualifying Cancers. These campaigns all worked well as digital TV Campaigns + Facebook.

We are currently testing Local PI as in City or Statewide and we are seeing promising results, again because we limit our Risk when we advertise as we only pay when we get people taking action by calling us.

Now that we have laidout our Digital TV strategy we are ready to deploy it with our clients. In the new year we will start publishing Digital TV cost per Case and Facebook Cost per case on all torts we run. We hope our clients and new clients will try out our Digital TV strategy and enjoy the stability, predictability, scalability and most of all mitigating the risk of advertising on TV.
