Phillips CPAP Recall – Cancer Causing Foam? + Connect with XSM In Vegas this Week!

First we always remember that when a new tort comes along we are talking maximum risk as not much is known yet about the project and not many studies have been done yet on this PUR foam being used in the Phillips CPAP machine to damper the noise from the engine.
So lets start with what we do know.
Voluntary Recall: Philips CPAP/BiPAP/ASV Sleep Apnea Machines got recalled on June 14, 2021.
What is nice about a voluntary recall is that you have time to make a 2nd product ready to replace the recalled product. However not so nice for the people that are breathing deathly cancer causing PUR foam. I am sure the evidence will show that Phillips knew long before they decided to recall the product that the PUR foam used was cancer causing. (Look into It).
How Many Victims: There are between 1-2 million Phillips CPAP machines in United states. Worldwide recall of 3-4 million machines for our European Mass Tort friends.
We know why the Phillips CPAP’s got recalled: Polyurethane (PUR) foam inside the CPAP machines puts users at risk for leukemia, breast cancer, liver cancer, lung cancer, pancreatic cancer, kidney cancer, and many more potentially deadly cancers. We know that PUR is a cancer causing agent, just like gasoline. In fact the foam is often referred to as “Solid Gasoline”.
Problem: So here is the problem in a nut shell. The foam, made from polyester-based polyurethane (PUR), decomposes over time. As it does so, it emits toxic gases that can cause illness, including asthma, headache, nausea and vomiting, hypersensitivity, respiratory problems, cognitive difficulties, and a number of different cancers.
What we are looking for:
Exposure: More then 6 month use of a recalled Phillips CPAP machine
Injuries: Several cancers are caused by inhaling gases emitted from polyurethane foam, including:• Leukemia• Breast cancer• Lymphatic cancer• Liver cancer• Nasal cancer• Lung cancer• Non-Hodgkin Lymphoma (NHL)• Brain cancer• Multiple Myeloma• Prostate cancer• Bladder cancer• Testicular cancer• Stomach cancer• Hematopoietic cancer• Papillary carcinoma and other thyroid cancers

This feels a lot like a Zantac but with more cancers and its easier to figure out if they used the product or not. Everyone with a CPAP machine knows exactly what mark and model they have. We think here is the beginning cancer cases are less then $500 and the price will increase as the market becomes aware of this new developing tort. I do want to Caution everybody that the earlier you get involved in a tort the more risk you are taking.

What nobody is taking but should be considered.
As we all know it takes time from exposure to a cancer diagnoses. Nobody are doing medical monitoring of the people that used the CPAP machines for future cancer diagnoses and the day the cancer does show up that person will have no SOL. A class of medical monitoring or taking all Phillip CPAP users for future claims is not being considered by anybody. I am sure there is a reason why ?
The Other New Tort Paraquat.
The cases have become easier to find as we have gotten more data on this tort. We are seeing case cost dropping in price from over $4,500 per case down towards as low as under $2-3k per case if you chose to take both diagnosed patients and patients with symptoms from indirect exposure.
1M people live with Parkinson’s and 60k people are diagnosed each year.

Why Your Law Firm Should Get Actively Involved in Sexual Abuse Cases.

As more and more states open up a look-back window for minors who where sexually abused, law firms should see this trend as a way to help Survivors that will have a hard time navigating the new laws. For many Survivors, this will help them get closure in their life on something that happened to them many decades ago. Closure is important for Survivors of sexual abuse as it provides a bookend to what happened to them as children. Sexual abuse many times follows the Survivors throughout their lives and changes a lot of things for them as they grow into adults. It’s important to recognize this and realize again, we are here to help real people, a core mission of X Social Media.
The Survivors are both men and women and below I will go though some of the closed and open cases that we know about to give some flavor to this tort for interested law firms.

Human Trafficking:

Unfortunately, there are many more human trafficking cases out there needing help and not enough law firms going after these cases to help..

FDA Recalls 246,831 Allergan BIOCELL textured breast implants

On July 24, 2019, Allergan announced a recall of all its BIOCELL Textured Breasts Implants and Tissue Expanders (“Recalled Implants”) due to the risk of Breast Implant Associated Anaplastic Large Cell Lymphoma.  Textured breast implants are supposed to reduce the risk of capsular contracture and have a better aesthetic appearance. The Recalled Implants have been on the market for over 25 years.  Symptoms of BIA-ALCL include seroma (build-up of fluid in the breast), pain, swelling, inflammation, itching, and capsular contracture. Per the FDA, there are 246,831 people that had the recalled Implants. 
Allergan came up short Friday March 19, 2021 in its attempt to escape claims in the multidistrict litigation. The company hid the cancer risks of its textured breast implants, with a New Jersey federal judge saying, “certain claims are not preempted by federal law and class allegations are still in play”.
In a 121-page opinion on the pharmaceutical giant’s dismissal motions, U.S. District Judge Brian R. Martinotti tossed on preemption grounds failure-to-warn claims over the BIOCELLl implant labels and other allegations but found that a manufacturing defect, negligence per se and other claims were not preempted.

This now opens the doors for three (3) different claim types that we can go after. First   women who still have product in place, women that have had the recalled product removed, and women that had already been diagnosed with BIA-ALCL a very rare type of blood cancer similar to non-Hodgkin’s lymphoma.
We are looking at a two-year SOL date of July 24 2021 so we still  have a few months to find these women and sign them up for possible compensation though the MDL.

The most represented states are California, Florida, New York, and Texas which combined comprise of about 40% of the implants.
We have good statistical data on where the implants are and who got them implanted.
44% implant as part of reconstruction
42% implants put in for cosmetic purposes.
14% Other reasons.

There are some common hospital systems and cancer treatment centers that we are aware of that have doctors that have used these implants with some frequency. These systems include Memorial Sloan-Kettering, the Cleveland Clinic and the Mayo Clinic.
Through advertising, we are looking to find the rest of these women that are part of this recall. All responses will go to a professional call center with the Co-Counsel’s specific criteria for sign up.
